General Terms and Conditions

StickFix e.U.

1. Scope

These General Terms and Conditions apply to all contracts, deliveries, and services of StickFix e.U. - controller and console repairs, upgrades, and modifications - with private and business customers in Austria, Germany, and Switzerland.

2. Services

StickFix offers repairs, upgrades, cosmetic modifications, and maintenance for controllers and consoles, including stick replacement, trigger modifications, mechanical buttons, soldering work, liquid metal replacement, and custom design modifications.

3. Contract Formation

A contract is formed when StickFix accepts a customer's request - in writing, by email, by phone, or in another form.

4. Prices and Payment

All prices are in € including applicable VAT (where applicable). Payment methods: cash, bank transfer, debit card.

5. Handover and Shipping

Pick-up and handover are possible on site during the specified hours. Shipping is available within Austria, Germany, and Switzerland. Shipping costs are borne by the customer unless otherwise agreed.

6. Processing Time

Repairs and upgrades are typically completed within 1-3 business days after receipt of the device, provided all required parts are available.

7. Warranty and Guarantee

Statutory warranty applies. In addition, StickFix provides a voluntary guarantee of 6 months from handover on all repairs, installed parts, and shop products.

Excluded from the guarantee are: damage caused by improper handling, external influences, normal wear and tear, and modifications by third parties.

8. Right of Withdrawal

As a consumer, you have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party designated by you took possession of the goods.

To exercise your right of withdrawal, you must inform us (StickFix e.U., Hyrtlgasse 6/5, 1160 Vienna, email: stickfix1140@gmail.com, tel: +43 664 923 89 04) of your decision to withdraw from the contract by means of a clear statement (e.g., by email or post).

To meet the withdrawal deadline, it is sufficient for you to send the notification of exercising the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from the contract, we must refund all payments we have received from you, including delivery costs (except for additional costs resulting from your choosing a different type of delivery than the cheapest standard delivery we offer), without undue delay and no later than 14 days from the day on which we received notification of your withdrawal.

You bear the direct costs of returning the goods.

Exceptions to the Right of Withdrawal (Section 18 FAGG (Austrian Distance Selling Act))

The right of withdrawal does not apply to contracts for goods made to customer specifications or clearly tailored to personal needs. This applies in particular to individually modified controllers (custom builds, custom paint jobs, individually configured paddle systems).

  • Date, signature (only for notification on paper)

(*) Delete as applicable.

9. Liability

StickFix is only liable for damages caused by intent or gross negligence. No liability is assumed for data loss, consequential damages from improper use, or damages that existed before handover.

10. Retention of Title

The goods remain the property of StickFix until full payment has been received.

11. Jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is - to the extent legally permissible - Vienna.
